Terms and Conditions

1. Who these Terms are between

These Terms are between Scott Gordon, trading as Crathes Audio (“Crathes Audio”), and you. They apply when you accept them as part of an invitation, account, order or supply of Crathes Audio software or services.

Crathes Audio currently makes Octavium Core available without charge through a verified Crathes account. Octavium remains in a limited invited preview and is not presently offered for public purchase.

The shared storefront password only controls access to the soft-launch presentation. It does not create an account, grant a licence, confer ownership or make an unavailable product available.

Submitting a pilot-interest request only asks Crathes Audio to consider you for the private test. It does not reserve a place, create an account, form a contract or guarantee an invitation. Crathes Audio may select a limited cohort according to testing needs and availability.

2. Your account and invitations

Your account and invitation are personal to you. You must provide accurate information, keep sign-in links and account access secure, and tell Crathes Audio promptly if you believe someone else has accessed your account.

Do not share or transfer an invitation, account, download or activation material. Crathes Audio may suspend access where reasonably necessary to protect an account, the service or other users, and will restore it when the concern is resolved where appropriate.

3. Software and installation limits

Software is licensed, not sold. The Software Licence sets out what you may do with it, including commercial use of audio you create, and what you must not do.

Each entitlement belongs to the named individual on the account and is subject to the installation cap shown with that entitlement. Product descriptions, supported systems and material limitations will be shown before supply.

4. Orders, prices and supply

An invitation, product page or checkout does not oblige Crathes Audio to accept an order. A contract is formed when Crathes Audio confirms the order or grants the relevant product access, whichever happens first.

Before any paid order, the price, taxes where applicable, payment provider and any additional conditions will be shown clearly. Crathes Audio may refuse or cancel an order for a genuine legal, security, pricing or availability reason and will return any payment taken for an order that is not supplied.

5. Digital delivery, cancellation and refunds

Where you are a consumer, you normally have 14 days to cancel a distance contract. If you expressly ask for a digital download or access to begin during that period and acknowledge that doing so ends the cancellation right, that right may end once supply begins.

This does not affect your statutory rights where software is faulty, misdescribed or not supplied with reasonable care and skill. In addition to those rights, Crathes Audio may offer a refund or other remedy as a matter of case-by-case goodwill. Contact support@crathesaudio.com with the account email and order details, but never send passwords, sign-in links or activation material.

6. Availability, updates and support

Crathes Audio will provide its services with reasonable care and skill but cannot promise uninterrupted availability. Maintenance, security work or events outside reasonable control may cause temporary disruption.

Future updates, major versions and services are not included unless expressly stated. Keep your own backup of downloaded installers and test software before relying on it in a live performance or production session.

7. Acceptable use

You must not misuse the website, account service or software; interfere with their security or operation; attempt unauthorised access; or use them unlawfully. Reasonable security testing requires advance written permission.

8. Liability and your legal rights

Nothing in these Terms limits statutory consumer rights or excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Subject to that, each party is responsible for loss that was reasonably foreseeable when the contract was formed. Crathes Audio is not responsible for loss caused by your failure to follow supplied requirements or reasonable instructions.

9. Ending access

You may stop using the services at any time. Crathes Audio may end or suspend access for a material breach of these Terms. Where a breach can be remedied, Crathes Audio will normally give you 14 days after written notice to remedy it.

Ending an account or service does not remove rights already granted for audio created lawfully under the Software Licence. Terms which by their nature continue after termination remain in effect.

10. Changes, law and contact

The version accepted for an order or supply governs that transaction. If a material change affects an existing service, Crathes Audio will give reasonable notice where practicable.

These Terms are governed by Scots law. The courts of Scotland have jurisdiction, but consumers may also use any court available to them under mandatory consumer law.
